Terms of Service

These Terms of Service (“Terms”) are a contract between you and Kraffic.ai (“Kraffic”, “we”, “us”), a product of Prime Team Agency. They govern access to https://kraffic.ai, our free brand check, customer and agency workspaces, and related services (the “Services”).

If you do not agree, do not use the Services. If you use the Services on behalf of a company, you represent that you have authority to bind that company to these Terms.

1. The Services

Kraffic helps brands and agencies measure how generative AI assistants (such as ChatGPT, Google Gemini, Claude and Perplexity) answer prompts related to a brand, and provides tools and recommendations to improve that visibility. Features may change as we improve the product.

No guarantee of AI answers. No one can guarantee what an AI assistant will say. Scores, rankings and samples are based on measurements we collect at specific times. Results can change between scans and across engines.

2. Accounts and eligibility

• You must provide accurate account information and keep it up to date.
• You are responsible for activity under your credentials and for keeping passwords confidential.
• You must be at least 16 years old (or the age of digital consent in your country) to create an account.
• If you sign in with Google or connect Google APIs, you also agree to Google’s applicable terms for that account, and our use of Google data is described in our Privacy Policy.

3. Free brand check

The homepage free check analyzes a public website URL you submit, suggests categories and competitors, and may run a limited live sample against an AI engine. Free checks are rate-limited, provided “as is”, and may be modified or discontinued at any time. Submitting a URL you do not own or are not authorized to evaluate is prohibited.

4. Acceptable use

You agree not to:

• Violate law, third-party rights, or these Terms.
• Probe, scan or attack our systems, or bypass rate limits, authentication or security controls.
• Scrape the Services in a way that burdens or harms our infrastructure, except via documented APIs we provide.
• Upload malware or content that is unlawful, harassing, or infringing.
• Misrepresent your identity or affiliation, or use the Services to spam or deceive.
• Use Google user data obtained through Kraffic for any purpose that violates Google’s API Services User Data Policy or Limited Use rules.
• Resell or white-label the Services except under a written agreement with us.

5. Your content and licenses

You retain ownership of content you submit (such as brand facts, prompts and materials). You grant Kraffic a worldwide, non-exclusive license to host, process, display and create derivative works from that content as needed to operate and improve the Services (for example running scans and generating reports).

You represent that you have the rights to submit the URLs and materials you provide, and that doing so does not violate any third-party rights or confidentiality obligations.

6. Our intellectual property

The Services, including software, design, trademarks and documentation, are owned by Kraffic or its licensors. Except for the limited right to use the Services under these Terms, no rights are granted to you.

7. Third-party services

The Services depend on third-party AI engines, hosting and tools. Those providers have their own terms and privacy policies. We are not responsible for third-party outages, model changes, or answers generated by those engines.

8. Paid plans and billing

If you purchase a paid plan, fees, billing cycle and cancellation terms will be shown at checkout or in your order form. Unless otherwise stated, fees are non-refundable. Late or failed payments may result in suspension. Managed GEO engagements may be subject to a separate statement of work.

9. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI ASSISTANTS WILL NAME YOUR BRAND, THAT SCORES WILL IMPROVE, OR THAT RESULTS WILL BE ERROR-FREE OR UNINTERRUPTED.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KRAFFIC AND PRIME TEAM AGENCY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR USD $100 IF YOU USE ONLY FREE FEATURES).

11. Indemnity

You will defend and indemnify Kraffic and its affiliates against claims arising from your content, your use of the Services, or your violation of these Terms or applicable law.

12. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms, create risk or legal exposure, or for prolonged inactivity on free accounts. Provisions that by nature should survive (including IP, disclaimers, liability limits and indemnity) will survive termination.

13. Governing law

These Terms are governed by the laws of the State of California, USA, excluding conflict-of-law rules, unless mandatory local consumer law requires otherwise. Courts in San Diego County, California will have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction.

14. Changes

We may update these Terms by posting a revised version on this page and updating the “Last updated” date. Continued use after changes become effective constitutes acceptance. If you do not agree, stop using the Services.
